Who you are contracting with
HavenOne is operated by Peter Allan, a sole trader, ABN 24 149 935 361. By creating an account or using the service you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind it.
The service
HavenOne is software for rental businesses: inventory, quotes, bookings, invoices, payments, security deposits, documents, driver scheduling and customer records.
We provide the software. We do not provide accounting, tax or legal advice, and figures shown in HavenOne — including tax calculations and financial reports — are your responsibility to verify before you rely on them.
Your account
Keep your account details accurate and your login credentials secure. You are responsible for what the users you invite do in your workspace. Tell us promptly if you believe an account has been compromised.
You must be at least 18 and use HavenOne only for lawful business purposes.
Acceptable use
When using HavenOne you must not:
Upload personal information you have no right to hold, or use it in ways the people it describes would not expect · send unsolicited bulk messages through the platform · attempt to access another business’s workspace, or probe, scan or test the security of the service · resell or white-label HavenOne without our written agreement · upload malware, or content that is unlawful, misleading or infringing · use automated means to place unreasonable load on the service.
We may suspend an account immediately where we reasonably believe one of these is happening and the risk to other customers is real. Where it is not urgent, we will raise it with you first.
Your data is yours
You own the data you put into HavenOne — your customers, bookings, invoices, documents and photographs. We claim no ownership of it. We use it only to run the service for you, as set out in our Privacy Policy. We do not sell it, and we do not use it to train machine-learning models.
Each workspace is isolated from every other workspace at the database level. You may export your data at any time while your subscription is active, in a format you can use elsewhere.
So that the software can actually work, you grant us permission to host, copy, back up, transmit and display your data — but only to operate the service for you, and only for as long as you use it. That permission ends when your data is deleted. It does not let us use your data for anything else.
We keep backups so your data can be recovered after a fault, but backups are our safety net rather than yours. Take your own exports of anything you would be unwilling to lose.
You are responsible for having the right to collect and hold the personal information you enter about your own customers, and for telling them how you handle it. If HavenOne handles personal information on your behalf, you are the entity accountable to those individuals for it.
Our intellectual property
HavenOne — the software, its interface, its documentation and the HavenOne name and logo — remains ours. Your subscription buys you the right to use it while you pay for it, not ownership of it.
Don’t copy, decompile or reverse-engineer the software, or build a competing product from it. If you send us feedback or suggestions, we may act on them without owing you anything — which is not us claiming your ideas, only avoiding an argument about whose idea a feature was.
Third-party services
HavenOne connects to services we do not control — Stripe for payments, Twilio for text messages, Google for calendar and email, among others. Where you enable one, that provider’s own terms apply to your use of it, and we are not responsible for their availability or their acts.
Our Privacy Policy names which providers receive data and where they operate.
Subscriptions and billing
Paid plans are billed in advance through Stripe. Plans, limits, trials, upgrades, downgrades and cancellations are managed in the billing area of the app. Prices are in Australian dollars and include GST where applicable.
Cancel at any time and you keep access until the end of the period you have paid for. We do not refund part-used periods except where the Australian Consumer Law requires it, or as set out in our Refund Policy.
If a payment fails we will attempt to contact you before restricting access. We may suspend or close an account for non-payment or misuse.
Availability
We take reasonable care to keep HavenOne available and to hold recoverable backups, but we do not guarantee uninterrupted access. Maintenance, third-party outages and faults happen. We may change or withdraw features over time; where a change materially reduces what you are paying for, we will tell you beforehand.
Ending the agreement
You may close your account at any time. We may end this agreement on 30 days’ notice, or immediately if you seriously or repeatedly breach these terms.
After your account closes, your data stays recoverable for 90 days so a mistake can be undone, then it is deleted. Export anything you need before that window closes.
Liability
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits those rights. For a major failure you are entitled to a refund and to compensation for any other reasonably foreseeable loss or damage.
Beyond those guarantees, and to the extent the law allows: we are not liable for indirect or consequential loss, lost profits, or lost data where you have not kept your own export; and our total liability in any 12-month period is limited to the subscription fees you paid us in that period.
You remain responsible for your own business decisions — pricing, availability commitments, contracts with your customers, and the accuracy of what you invoice.
Your responsibility to us
If someone brings a claim against us because of data you put into HavenOne — you had no right to hold it, or you used it in a way you should not have — you agree to cover our reasonable costs in dealing with it. The same applies to a claim arising from your breach of these terms.
This is not us shifting our own failures onto you. It covers claims caused by your use of the service, and we will tell you promptly about any claim and let you take part in resolving it.
Changes to these terms
We may update these terms. Material changes will be notified by email at least 14 days before they take effect, and continuing to use HavenOne after that means you accept them.
Governing law
These terms are governed by the laws of Queensland, Australia, and the courts of Queensland have non-exclusive jurisdiction.
If you are elsewhere in Australia, this does not reduce your rights. The Australian Consumer Law applies nationally, and your protections under it are the same in every state and territory regardless of this clause.
General
If one part fails, the rest stands. Should any provision be found unenforceable, it is severed and the remainder continues to apply.
This is the whole agreement between us about HavenOne, replacing anything said beforehand. Not enforcing a term on one occasion does not waive it.
Assignment. You may not transfer your agreement without our consent. We may transfer ours if the business is sold or restructured, and will tell you if that happens.
Notices go to the email address on your account, and to us at the address below. Neither of us is liable for failures caused by events genuinely beyond our control.
